01

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Arithmony ("Company," "we," "us," or "our") governing your access to and use of the Arithmony web application and any related services (collectively, the "Service").

By creating an account, accessing the Service, or clicking "I Agree," you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Service.

02

Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Be a resident of the United States or a jurisdiction where the Service is available
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Service under applicable law

By using the Service, you represent and warrant that you meet all eligibility requirements. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

03

Your Account

To access most features of the Service, you must register for an account. When creating your account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account at support@arithmony.com
  • Accept responsibility for all activity that occurs under your account

You may not share your account credentials with others or create multiple accounts for the purpose of circumventing restrictions. We reserve the right to suspend or terminate accounts that we believe are being misused.

04

Subscriptions & Billing

Plans

Arithmony offers paid subscription plans. Each plan includes a 14-day free trial. No payment is charged until the trial period ends. The following plans are currently available:

Harmony — Monthly

$8.00 / month

Billed monthly. Full access to all Harmony features. 14-day free trial included. Renews automatically each month until cancelled.

Duet — Monthly

$14.00 / month

Billed monthly. Full access to all Duet features, including multi-user access. 14-day free trial included. Renews automatically each month until cancelled.

All prices are stated in US dollars. Current plan details and any promotional pricing are displayed within the Service at checkout. Features included in each plan are described on our pricing page and may be updated from time to time with reasonable notice.

Free Trial

Each paid plan includes a 14-day free trial for new subscribers. No charge is applied until the trial period ends. You will be notified of the trial end date at sign-up. If you cancel before the trial ends, you will not be charged. At the end of the trial, your selected plan will begin billing automatically unless cancelled.

Billing & Renewal

  • Paid subscriptions are billed in advance on a recurring basis — monthly or annually, as selected at checkout.
  • Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
  • You authorize us to charge your payment method on file for each renewal period at the then-current plan rate.
  • All fees are exclusive of applicable taxes, which you are responsible for paying.
  • Annual subscriptions are charged as a single upfront payment for the full year.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until that date. We do not provide refunds for partial billing periods, whether monthly or annual.

Price Changes

We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price increase via email. Your continued use of the Service after a price change constitutes acceptance of the new pricing. If you do not accept a price change, you may cancel before it takes effect.

Payment card information is processed and stored by our third-party payment processor. Arithmony does not store your full card number, CVV, or other sensitive payment details on our servers.

05

Plaid & Financial Connections

Certain features of Arithmony allow you to connect your bank and financial accounts through Plaid Technologies, Inc. ("Plaid"). By using these features, you agree to Plaid's Terms of Use and Privacy Policy in addition to these Terms.

  • You authorize Arithmony to access, through Plaid, the financial account data necessary to provide the Service, including but not limited to account balances, transaction history, and account identifiers.
  • This access is read-only. Arithmony cannot and will not initiate transfers, payments, or any transactions on your behalf.
  • You represent that you are the authorized account holder of any financial accounts you connect, or that you have permission from the account holder to connect such accounts.
  • You may revoke Arithmony's access to your financial accounts at any time via your account settings. Revoking access may limit the functionality of the Service.

Important: Arithmony is a budgeting and financial tracking tool. It is not a bank, investment adviser, broker-dealer, or financial institution. The Service does not provide financial, investment, tax, or legal advice. Financial data displayed in the Service is provided for informational purposes only.

06

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service in any way that violates applicable federal, state, or local law or regulation
  • Attempt to gain unauthorized access to any part of the Service, other user accounts, or our systems
  • Use automated means (bots, scrapers, crawlers) to access or collect data from the Service without our express written permission
  • Transmit any malicious code, viruses, or harmful software through the Service
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Use the Service to process or store data belonging to others without their authorization
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service

We reserve the right to investigate and take appropriate action against violations of these provisions, including suspension or termination of accounts and referral to law enforcement.

07

Intellectual Property

The Service, including all content, features, functionality, design, logos, trademarks, and software, is owned by Arithmony and protected by United States and international intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms. This license does not include the right to sublicense, sell, resell, copy, or modify any part of the Service.

You retain ownership of the data you input into the Service (your budget data, notes, and goals). By using the Service, you grant us a limited license to store, process, and display that data solely for the purpose of providing the Service to you.

08

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Arithmony disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Financial data displayed in the Service will be accurate, complete, or current at all times
  • Any errors in the Service will be corrected
  • The Service will meet your specific requirements

Financial data is sourced from third parties including Plaid and your financial institutions. Arithmony is not responsible for inaccuracies in data provided by these third parties. You should verify important financial information directly with your financial institution.

09

Limitation of Liability

To the fullest extent permitted by applicable law, Arithmony and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, data, or business opportunities
  • Financial decisions made based on information displayed in the Service
  • Unauthorized access to or alteration of your data
  • Interruption or cessation of the Service
  • Errors or inaccuracies in financial data provided by third-party services

In no event shall Arithmony's total cumulative liability to you for any claims arising from or relating to these Terms or the Service exceed the greater of (a) the total amount you paid to Arithmony in the twelve months preceding the claim, or (b) $50 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

10

Indemnification

You agree to defend, indemnify, and hold harmless Arithmony and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service in violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any content or data you submit to or through the Service
11

Termination

You may terminate your account at any time by using the account deletion feature within the Service or by contacting us at support@arithmony.com. Upon termination, your right to use the Service ceases immediately.

We may suspend or terminate your account and access to the Service at our discretion, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful behavior, or for any other reason we deem appropriate. In cases of material violation, we may terminate without prior notice.

Upon termination, we will delete your personal data in accordance with our Privacy Policy, subject to any legal obligations to retain certain records. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and dispute resolution — will survive.

12

Dispute Resolution

Informal Resolution

Before filing any formal legal claim, you agree to contact us at legal@arithmony.com to attempt to resolve the dispute informally. We will make a good-faith effort to resolve any dispute within 30 days of receiving your notice.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Arithmony is headquartered, without regard to conflict of law principles.

Arbitration

If informal resolution fails, you and Arithmony agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: You and Arithmony agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

13

General Provisions

  • Entire Agreement. These Terms, together with the Privacy Policy and any additional terms you agree to, constitute the entire agreement between you and Arithmony regarding the Service.
  • Severability. If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.
  • Waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
  • Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.
  • Updates to Terms. We may update these Terms from time to time. Material changes will be communicated by email or prominent notice within the Service at least 14 days before taking effect. Continued use of the Service after updated Terms take effect constitutes acceptance.
  • Force Majeure. We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, internet or infrastructure failures, or third-party service outages.
